Present Privacy Policy (referred as Policy) applies to the collection, use and disclosure of user‘s Personal Data by the AppSmartz (referred as Company) while using the Mobile App DramaFlix (referred as App) or its website

• Definitions

• App: means the mobile App named DramaFlix run by the Company

• Collected Data: means the personal data collected, stored, disclosed or used by the Company from a user or visitor to the App at any other apps, websites, other channels or platforms of the Company. Word ‘collected‘ means the data collected by the company either from its independent sources or from the third parties or social media of the user/visitor, where the user has shared his personal or other information voluntary or shared by any entity for any purpose.

• Personal Data: means the correct data with its numbers and figures, whether true or not, about a user/visitor who can be identified from that data; or from that data and other information which an entity/organisation has or is likely to have access. It shall also refer to that which is already in the possession of Company or that which shall be collected by the Company in future. This data includes: Name, Email address, Gender, Personal Data of your emergency contacts, IP addresses, Photographs and images. It may be day to day activity, including via company‘s performances, workshops, websites, events and any forms used by it from time to time

• General

• Company, its officers, directors, employees shall use reasonable endeavours to respect the confidentiality of and keep safe the collected data.

• Company shall use reasonable endeavours to ensure that the data shall be done in an appropriate manner and in accordance with the present Policy.

• While using or visiting the App, the company may seek some information from you and while submitting information by you, while interacting with us, while signing up for any product or service of the company or its products, you agree and consent to the App for collecting, using, storing, disclosing and sharing amongst the collected data

• You hereby duly authorize the company to share, use and disclose the collected Data to the company‘s service providers, sister concerns, relevant third parties for any purpose including the purpose of advertisement, or use it commercially.

• This Policy is in addition to any other consent you may have previously provided to us in respect of your Personal Data.

• You can get your collected data modified by giving a legitimate request and the App either shall provide you the access for the same OR may modify the same as requested by you as soon as possible, but within maximum 30 days from the date of such request.

• you may register your query/complaint/grievance on the company’s email address support@appsmartz.com and the same shall be resolved/redressed by the company within a fixed time subject to some exceptions.

• if the company has collected your personal data from a third party, then, you need to contact such third party to refer your query, complaint, grievance to the company on your behalf.

• you can restrict the company to use your collected data for one or more purposes by sending a specific communication on the email address support@appsmartz.com.com. Your such request shall be processed within 7 days. However, such request may affect our ability to fulfill your needs in any particular event or field, area of use of technology.

• This Policy only applies to the collection and use of Personal Data by the company. It does not cover third party sites to which we provide links, even if such sites are co-branded with our name and logo.

• Company does not share your Personal Data with third party websites. Company is not responsible for the privacy and conduct practices of these third party websites, so you are recommended to read their own privacy policies before disclosure of any Personal Data to these websites.

• The parents if found using the App of the company by their kids below the age of 18 years are suggested to stop them to use it or they may allow them to use it in their supervision. Company does not allow any minor, person of unsound mind or mentally disable to use the app.

• to ascertain if you are eligible for any benefit, discount, privileges or other related purposes,

• for our advertisement, promotions on our all mobile apps and websites and to share the same with our associates, sister concerns, in all the platforms of the company.

• to maintain and update your details with the company,

• for direct marketing through email, direct mail and facsimile messages,

• for payment and/or credit control purposes,

• Sharing/disclosure of collected data

• Law Regulator and Enforcement Agency, Crime Investigation Agencies, Courts of law to the extent, it is required by the agency or court,

• Potential buyers or investors of the company Or to the prospective purchaser of any business or asset which we propose to sell,

• Banks, Credit, debit and charge card companies and other payment processing entities to the extent of processing the payment,

• Third Service providers and consultants of the company for its services,

• Agency or sub-contractor working for company to sell its business in whole or in part and to such purchaser who buys our business or its any part With your consent and for the purposes of disaster recovery.

• You may also request to provide your certain personal data to use to improve the company’s products and services and to request for personalised service, or provision of a product or dependent. This type of data includes, but is not limited to: Your age, Gender, Education and Profession, Family and household demographics, Salary and employment details, Hobbies and leisure activities and other related products and services subscribed to

• Company may share your data in some circumstances, to any business associate, partners, sister concerns of the company for the purposes of quality control, appraisal, as well as staff management and development.

• You hereby authorize the company, its affiliates, agents and third parties providing services to it across the globe.

By agreeing to this Policy, you hereby give your consent for the collection, use and disclosure of such Personal Data for the purposes of our records, following up with your enquiry and/or transaction, and for quality control and training purposes and also for the purposes mentioned above.

• Protection, Access and Control of Personal Data

• Company uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your Personal Data and will not knowingly allow access to this data to anyone outside the company other than to you or as described in this Policy.

• However, we cannot ensure or warrant the security of any information you transmit to us and you do so entirely at your own risk. In particular, we do not warrant that such information may not be accessed, altered, collected, copied, destroyed, disposed of, disclosed or modified by breach of any of our physical, technical, or managerial safeguards.

• In case a breach of your personal data comes to our knowledge, we will notify you without undue delay and in any other case of breach of your personal data, which is likely to result in a high risk to your rights and freedoms, we shall inform you without any delay. You have right to: -

• check whether company holds any Personal Data relating to you and, if so, obtain copies of such data,

• require the company to correct any Personal Data relating to you which is inaccurate for the purpose for which it is being used,

• to verify the details you have submitted to the company or to check on the manner in which the company uses and processes your personal data

• Company honors the laws across the globe and its data protection policy has been made in compliance of Indian laws DPDPA as well laws of other states/countries CCPA (US), PIPA (Korea), LGPD (Brazil), COPPA (US), PDPA (Singapore), New zealand Privacy Act and others.

• In addition to any opt-out feature provided by any of the services listed in this document, a user may follow the instructions provided by his Online Choices (EU), the Network Advertising Initiative (US) and the Digital Advertising Alliance (US), DAAC (Canada), DDAI (Japan) or other similar initiatives.

• The rights of a user are based on the General Data Protection Regulation (GDPR)

• Company does not share your Personal Data with third party websites. Company is not responsible for the privacy and conduct practices of third party websites, so you should read their own privacy policies before disclosure of any Personal Data to these websites.

• Company will not sell your personal information to any third party without your permission, but we cannot be responsible or held liable for the actions of third party sites which you may have linked or been directed to Dramaflix or other mobile application or websites of the company.

• Storage and Retention of Personal Data

• Company will delete, as reasonably possible, or otherwise anonymise any Personal Data in the event that it is not required for any reasonable business or legal purposes of the company, where the Personal Data is deleted from the company’s records, systems according to the company’s internal policies, procedures and/or other agreements.

• Destruction of Information

• To get the account and his data deleted, a user can request to delete his account by clicking on ‘Delete‘ button present in Settings in the app (while he is logged in) OR he may also send a request to Company to delete the same at support@appsmatz.com. On receiving request, Company will delete the account after verifying the user‘s login ID (email). On deletion of the account, the data of user shared with the Company will be deleted on expiry of 180 days of such deletion in compliance of Information Technology Rules 2021 notified by the Govt. of India. On deletion of account, his future subscription, if any will not be stopped automatically. To stop future subscription, if any, a user will need to unsubscribe from the Play Store or App Store, from where he purchased the premium features.

• You will provide your correct contacts to the company for the purposes of communication and updates of services, products and policies etc. Till the request of change of any contact by you, it shall be presumed that the contact details already provided by you is true and correct for all purposes including communication purposes. By agreeing this policy, you hereby grant the company a clear and unambiguous consent to contact you using all of your communication means you have provided to it for communications applications or methods.

• Your contacts

• You will provide your correct contacts to the company for the purposes of communication and updates of services, products and policies etc. Till the request of change of any contact by you, it shall be presumed that the contact details already provided by you is true and correct for all purposes including communication purposes. By agreeing this policy, you hereby grant the company a clear and unambiguous consent to contact you using all of your communication means you have provided to it for communications applications or methods.

• Change of Policy

• Company reserves the right to modify any of the clauses stated herein in compliance with local legislation, and for any other purpose deemed reasonably necessary by the company. It is recommended to look at these terms regularly. You can inform the company, if you are not agreed with any modified clause to which you do not consent within one week of such modification and not thereafter.

• Governing Law

• This Policy is governed by and shall be construed in accordance with Indian laws. You hereby submit to the non-exclusive jurisdiction of the Indian courts.
